Please read these Terms and Conditions carefully before using ByChance. By accessing or using our service, you agree to be bound by these terms.

1. Acceptance of Terms

By downloading, installing, or using ByChance, you agree to these Terms and Conditions. If you do not agree with any part of these terms, you may not use our service.

2. Description of Service

ByChance is a social entertainment platform that connects people through live party rooms, voice chats, video calls, and social games. The service includes:

  • Live party rooms for voice and video conversations
  • Real-time voice and video chat
  • Interactive social games
  • Virtual gifts and rewards
  • Multi-language support

3. Acceptable Use and Restrictions

You agree not to use ByChance for any of the following:

Illegal or Unlawful Use

  • Violating any law or regulation
  • Using ByChance to record or transcribe another person without their consent where required by law

Security and Technical Restrictions

  • Reverse engineering, decompiling, or attempting to access ByChance's source code
  • Tampering with or probing non-public parts of the Services
  • Launching security attacks such as overloading, flooding, malware distribution, or unauthorized access attempts

Harmful or Abusive Use

  • Using ByChance for harassment
  • Generating harmful, threatening, or abusive content
  • Any use that risks harm to others or to ByChance

AI-Specific Restrictions

  • Using outputs to train competing AI or machine learning systems
  • Presenting ByChance outputs as professionally reviewed or vetted
  • Using ByChance for automated decision-making with legal or similarly significant effects

We reserve the right to restrict access if these rules are violated.

4. Third-Party Services

ByChance relies on secure, cloud-based third-party providers to process voice, video, and text, including:

  • Cloud infrastructure providers
  • Video and voice streaming services
  • Payment processors

These providers may change over time. They process data only to provide our services, subject to their own policies and infrastructure.

5. Software License

ByChance grants you a limited, revocable, non-exclusive, non-transferable license to use ByChance solely for personal, lawful use under these Terms.

Updates may be delivered automatically. Open-source components, if included, are licensed under their respective open-source licenses, which override these Terms where applicable.

6. Beta Features

We may release early-stage or experimental features ("Beta Services"). Beta features may be incomplete, unreliable, or change at any time.

By using Beta Services, you agree that ByChance may contact you for feedback, and you agree not to disclose details of unreleased features unless publicly announced.

7. Paid Services and In-App Purchases

A. App Store Billing

Any upgrades, subscriptions, or in-app purchases are processed exclusively through:

  • Google Play Store (for Android)
  • Apple App Store (for iOS)

Your purchase is governed by the respective store's payment terms, billing rules, and refund policies.

B. Refunds

Refunds are not issued by ByChance directly. Refunds follow Google's or Apple's policies for your region.

C. Taxes

You are responsible for any required taxes imposed by your jurisdiction.

8. Termination

You may stop using ByChance at any time by uninstalling the app.

We may suspend or terminate access if:

  • You violate these Terms
  • Continued operation becomes impractical due to legal or technical circumstances
  • ByChance is discontinued or replaced

If you paid for a service through an app store, refund eligibility is determined by the app store.

9. Warranty Disclaimer

ByChance and all related services are provided "as is" and "as available."

To the fullest extent permitted by law, ByChance disclaims all warranties, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy, reliability, or timeliness of outputs
  • Error-free or uninterrupted operation

Some jurisdictions do not allow certain disclaimers, so they may not apply to you.

10. Limitation of Liability

To the fullest extent permitted by law, ByChance is not liable for:

  • Loss of profits, data, or use
  • Indirect, incidental, special, consequential, or punitive damages
  • Errors, inaccuracies, or defects in transcription
  • Unauthorized access or use of the Services
  • Service interruptions, bugs, malware, or failures
  • Issues caused by third-party providers

Where liability cannot be excluded, it is limited to the maximum amount allowed by law.

11. Indemnification

You agree to indemnify and hold harmless ByChance and its officers, employees, and contractors against claims arising from:

  • Your misuse of the Services
  • Your violation of these Terms
  • Your violation of law or third-party rights

This does not apply to claims caused by ByChance's own breach of these Terms.

12. Dispute Resolution and Arbitration

A. Informal Resolution

Before filing a claim, you agree to attempt to resolve the dispute by emailing us at bychance.team@gmail.com.

B. Arbitration

If unresolved after 60 days, disputes will be resolved through binding arbitration in accordance with the American Arbitration Association (AAA) Consumer Arbitration Rules.

C. Venue

For claims not subject to arbitration, disputes must be brought in the state or federal courts of Texas, and you consent to jurisdiction there.

D. No Class Actions

You agree to resolve disputes only on an individual basis. Class actions and representative actions are not permitted.

13. Copyright and DMCA

ByChance respects intellectual property rights. If you believe content violates your copyright, you may submit a DMCA notice to:

We may remove content and/or restrict access in accordance with applicable law.

14. Modifications

We may update these Terms periodically. If updates meaningfully reduce your rights, we will provide notice within the app or on our website.

Continued use of ByChance after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of Texas, excluding its conflict-of-law principles.

Users in countries with mandatory consumer protection laws retain those rights.

16. General Provisions

  • These Terms constitute the entire agreement between you and ByChance.
  • If any part is unenforceable, the remaining terms remain in effect.
  • You may not assign your rights under these Terms.
  • ByChance may assign these Terms to a successor or affiliate.
